Change May Be Good For The Collections Industry

In today’s recession, collection companies are not immune. Beginning last year, they started to suffer from declining liquidation performance, staffing cuts, and increased placements.

Then in January 2009, the U.S. savings rate spiked and continued to grow. By May 2009 the rate was the highest level of savings by consumers in sixteen years.

Usually, an increase in the U.S. savings rate would mean that consumers will be more fiscally responsible and try to pay off debts that they may owe in case of an unexpected adverse event. Unfortunately the first half of 2009 has shown us that this is not what is going to happen and the collections industry should not expect it to.

These are strict regulations and rules that a debt collector must follow, and if any of these rules are broken, there is a great possibility that take the agency that violated the FDCPA to court. But what about that deadbeat friend of yours who owes you five bucks? Are you required to grant them thirty days to refute your claim? Clearly, as both you and your friend’s wallet know, you don’t.

If you owe debt to a creditor collection agencies are allowed to report your debt to credit bureaus, file lawsuits against you, and should be taken very seriously. The best way to protect yourself and your financial situation is a methodical approach. First, know why you are being contacted. Know where the debt is from and exactly how much it costs.

Find out the name of the person calling, the agency, the creditor, and the agency’s address and fax number. Under the FDCPA, you have the right to tell a collector over the phone that you want all future contact to be in writing. Follow up all requests with a written request.

In the news recently, Buffalo New York has been home to a number of unlawful debt collection practices, and police have arrested at least twelve people who have broken regulations. Toll Booths In Texas Shape Up And Ship Out

In Dallas, the North Texas Tollway Authority, an entity responsible for collecting tolls, has been under fire for months over its toll collecting policy. This policy charges drivers who do not pay up at the toll booth fines of hundreds, or even thousands, of dollars. Because the NTTA has been scrutinized by the public, it announced today that they are taking two steps it says that will target improving customer satisfaction.

The first measure that the NTTA took was to allow all drivers to utilize the electronic toll collection lanes, including those who do not have one. They can do this without being punished with a twenty five dollar fine.
